By accessing or using the Cyla application, website, or any associated services (collectively, the “Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

2. Eligibility

You must be at least 13 years old to use Cyla. If you are between 13 and 18, you must have parental or guardian consent. By using the Service, you represent and warrant that you meet these eligibility requirements.

3. Account Registration

To access certain features, you may need to create an account. You are responsible for:

  • Providing accurate, current, and complete information during registration.
  • Maintaining the security and confidentiality of your login credentials.
  • All activities that occur under your account.
  • Notifying us immediately of any unauthorized use of your account.

Cyla grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use in accordance with these Terms.

  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Attempt to gain unauthorized access to our systems or other users' accounts.

  • Scrape, data-mine, or use automated means to access the Service without our written consent.
  • Reproduce, distribute, or create derivative works based on the Service without authorization.

Cyla is not a medical device and does not provide medical advice. The predictions, insights, and information provided by Cyla are for educational and informational purposes only. 6. Intellectual Property

All content, features, and functionality of the Service — including text, graphics, logos, icons, images, audio, software, and the underlying code — are the exclusive property of Cyla or its licensors and are protected by copyright, trademark, and other intellectual property laws.

Your use of the Service does not grant you any ownership rights in any content, code, data, or materials you may access through the Service.

7. User Content

You retain ownership of any content you submit to the Service (such as cycle data and health logs). By submitting content, you grant Cyla a limited license to use, process, and store it solely for the purpose of providing and improving the Service, as described in our Privacy Policy.

8. Third-Party Services

The Service may contain links to or integrations with third-party websites or services. We are not responsible for the content, privacy practices, or terms of any third-party services. Your use of third-party services is at your own risk.

9. Subscription and Payments

Some features of Cyla may require a paid subscription. Subscription terms, pricing, and billing cycles are presented at the time of purchase. Subscriptions automatically renew unless cancelled before the renewal date. Refund policies are governed by the applicable app store (Apple App Store or Google Play Store) terms.

10. Limitation of Liability

To the maximum extent permitted by law, Cyla and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service. This includes, but is not limited to, damages for loss of data, health decisions made based on the Service, or service interruptions.

In no event shall our total liability exceed the amount you paid to Cyla in the twelve (12) months preceding the claim.

11. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

12. Indemnification

You agree to indemnify and hold harmless Cyla and its affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. You may terminate your account at any time by contacting us or using the account deletion feature in the app. Upon termination, your right to use the Service ceases immediately, though provisions that by their nature should survive (including limitation of liability, indemnification, and dispute resolution) will remain in effect.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of Berlin, Germany.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes through the app or by email at least 30 days before the changes take effect. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
